📋 What is a Responsible Person? 
Ensuring adherence to regulations mandates the appointment of a Responsible Person for every product introduced to the market. This designated individual carries the responsibility of meticulously managing a comprehensive Product Information File (PIF), which undergoes scrutiny by regulatory authorities. The PIF is required to encompass crucial information like product description, safety report, and adherence to Good Manufacturing Practice (GMP) throughout the production process.

Precise cosmetic labeling requirements encompass details such as an EU address (where the PIF is accessible), ingredient declaration, expiry date, and contact information for customer care.
Choosing the right one is challenging. While many claim qualification, only a few can truly fulfill these critical tasks:
  1. Safeguard your brand from compliance issues.
  2. Offer legal guidance on European Cosmetics Regulation.
  3. Address inquiries from National Competent Authorities (27 EU Member States + UK).
  4. Oversee inspections mandated by Supervisory Competent Authorities.
  5. Monitor regulatory changes and provide detailed impact assessments.
  6. Ensure the safety and well-being of consumers who use cosmetic products on a daily basis and respond to reports of undesirable effects.
  7. Maintain comprehensive cosmetic product files.
📋 Why must I have an RP? 
For cosmetic brands without a European office, it's required by law in the EU and UK. See link to European Cosmetics Regulation EC No 1223/2009 Art. 4-5. However, this can be costly and challenging remotely.
Alternatively, relying on your importer or distributor to act as the Responsible Person seems ideal. Yet, many hesitate due to:
  1. Lack of qualifications in regulatory, legal, toxicology, and pharmaceutical sciences.
  2. Insufficient language and communication skills for managing diverse interactions.
  3. Significant time investment, often beyond importers' primary focus on marketing and sales.
Post-Brexit, selling cosmetics in the UK mandates a local Responsible Person. Brands selling in both the EU and UK need representation in both regions.

Considering these challenges, it's advisable to engage an independent, qualified Responsible Person before discussions with European importers or distributors.
